Companies challenge ban on fixed-dose combination drugs

Drug companies including Glenmark, Pfizer and Procter & Gamble have contested the government’s power to regulate, restrict and prohibit the manufacture of 344 widely sold fixed-dose combinations such as Corex, D’cold and Saridon without consulting the technical advisory board.

The government defended the move, citing public interest and claimed the ban was imposed on the basis of recommendations of a committee that blamed such drugs for toxicity and antibiotic resistance among the people. The government had also argued that most such combination drugs had been banned outside India, too, which the companies denied.

The companies have argued that before prohibiting fixed-dose combination drugs, the government must consult the statutory bodies provided for in the Drugs and Cosmetics Act, 1940 otherwise the power would be unfettered, unlimited...
