Legal consequences of inappropriate medical response after a diagnosis
Following precautions have been advised by the Court:
-Inordinate delay in response or lack of any response to an ailment after diagnosing the same in the absence of any medically sound justification is negligence per se
-Each and every symptom of the patient must be appropriately responded to. In case a symptom has to be ignored, reasons for any such decision must be specifically recorded in the patient's medical records
-Failure to diagnose an ailment at the appropriate moment could be construed as negligence
-Poor hygiene condition of a hospital or nursing home is negligence per se.
-Inadequacy in postoperative care is negligence
