Medico legal Case# 9 - The beginning of a new trend? Experience of the doctor specifically taken into account by the court
Facts of the case

The patient was admitted to the hospital with the complaint of neck pain for the past 4 years. The neurosurgeon diagnosed her as a case of cranio-vertebral junction anomaly, i.e. atlantoaxial dislocation (AAD), and performed a surgery. The patient did not get any relief and later her whole body got paralyzed. About 25 days post surgery, in the morning, the patient suffered from chest pain, vomiting, and breathing problem. The patient was shifted to ICU, suffered cardio-respiratory arrest, and was declared dead by noon.

Patient's allegation/s of medical negligence

- It was alleged that the neurosurgeon orally assured the relatives that the patient would be cured within 2 weeks after the operation
- Neither examined the patient properly nor explained the mode of treatment and complications of operation; left in between the surgery; and
- Gave high doses of steroid post surgery, which caused psychosis. It was alleged that the patient's condition deteriorated because of the unhygienic conditions in the ward.

Good lesson for the junior residents as well as the operating surgeon about the importance of pre-op counselling and patient communication... happy to see that court did not impose any terminal punishments for the doctor..
