After NMC Bill was signed by the President to constitute NMC replacing the current MCI, the Union Health Ministry recently issued a gazette stating that certain specific provisions of the Act would be coming into force from 2nd September 2019. The gazette released the effectiveness of the sections which will start the task of the formation of NMC and various boards under NMC.
The gazette states that "In exercise of the powers conferred by sub-section (3) of section 1 of National Medical Commission Act, 2019 (30 of 2019), the Central Government hereby notifies that the provisions of sections 3, 4, 5, 6, 8,11, 16, 17, 18, 19, 56 and 57 of the said Act shall come into force with effect from the 02nd day of September 2019."
Some important provisions which are going to be implied under this gazette are:
Section 3: The Central Government will constitute a Commission, to be known as the National Medical Commission, to exercise the powers conferred upon, and to perform the functions assigned to it, under this Act.
Section 4: The Commission to consist of the following persons to be appointed by the Central Government, namely:
(a) a Chairperson;
(b) ten ex officio Members; and
(c) twenty-two part-time Members.
Section 11: The Central Government will constitute an advisory body to be known as the Medical Advisory Council.
Section 16: The Central Government will, by notification, constitute the following Autonomous Boards, under the overall supervision of the Commission, to perform the
functions assigned to such Boards under this Act, namely:—
(a) the Under-Graduate Medical Education Board;
(b) the Post-Graduate Medical Education Board;
(c) the Medical Assessment and Rating Board; and
(d) the Ethics and Medical Registration Board.
