Patient chooses doctor- Hospital is liable?
- Law in India is very clear about the fact that hospitals are always liable for the negligence of their doctors, nurses, and staff even if the patient chooses a doctor or the doctor whom the patient is consulting chooses the hospital.
- In case of an elective surgery, if any shortcoming, contraindication or such other problem is noticed, the surgery should be postponed rather than proceeding with the same.
- Post-surgery complications must be detected and appropriate remedial steps must also be taken within a reasonable time. Failure to do so could be negligence.
- Nil-by-mouth instructions must be given specifically to the patient and in case of hospitalised patients, it must be ensured that the same have been properly followed.
