Precautions where relapse or recurrence is a known possibility
Following precautions have been advised by the Court:

-In surgeries/treatment where relapse or recurrence is a known possibility, it is advisable to follow the following:

-Specifically, point out the fact that relapse or recurrence is a possibility
while taking consent

-Consent must specifically record this possibility

-In case of IPD patients, the discharge card must specifically record the fact that such a possibility exists; precautions, if any, that ought to be taken to avoid the same; and signs of relapse or recurrence

-All instances of the patient not following medical advice must be duly recorded


Facts of the case —

The patient had direct inguinal hernia, for which he underwent surgery. After discharge, hernia recurred and re-surgery was suggested to him. It was alleged that the hospital and the surgeon (OPs) were negligent in performing surgery as hernia had recurred.
