The Kerala high court has upheld a single bench's ruling that private medical colleges do not have the authority to withhold MBBS certificates of merit candidates who do not do one-year compulsory service. The court also said the colleges cannot withhold certificates submitted at the time of admission but can only insist for compensation.

Relying on an agreement executed between the college management and the parents at the time of admission, it was contended by the management that they have the right to withhold the MBBS certificate and other certificates. Clause 8 of the agreement authorises the management to retain the certificates submitted at the time of admission or the MBBS certificate earned by the students upon completion of the course, the counsel for the college management argued.
