After model-actress Rhea Chakraborty's complaint, the Mumbai Police have registered an FIR against late actor Sushant Singh Rajput's sisters and Dr Tarun Kumar of Ram Manohar Lohia Hospital under the provision of IPC 1860, the Narcotics Drugs and Psychotropic Drugs Act, 1985, and Telemedicine Practice Guidelines, 2020.

~ Prescribed scheduled drugs to the late actor, which are listed in Schedule of NDPS Act listed at items 36 and 37 as Psychotropic Substances

~ Tele Medicines Practice Guidelines 3.7.4 dealing with Prohibited List, which prohibits prescribing of any Narcotic or Psychotropic Substance listed in the NDPS Act. (Misconduct under of the Tele Medicine Practice Guidelines.)

Complaint claimed:

Late actor's sister had sent a prescription to Sushant by Dr Tarun Kumar and he "appears to have prescribed medication controlled under Narcotic Drugs and Psychotropic Substances Act, 1985 to Sushant without any consultation as mandated by law".

The actress further states that the "drugs prescribed by the doctor (Dr Tarun Kumar) were prohibited from being prescribed electronically under the Telemedicine Practice Guidelines, 2020".

In accordance with orders of the Supreme Court, the case has been transferred to CBI for further investigation.

This seems to be a case of forged prescription for a narcotic drug than a case of not following telemedicine guidelines. Also, whether or not a teleconsultation actually happened is not clear from the available information at this time.

Learning: Doctors need to be careful while issuing prescriptions via any electronic platform. A documented informed consent and attention to drug class being prescribed is very important for a teleconsult.
