Supreme court relief for students in Ayush courses sans NEET

In a major relief to hundreds of students whose admissions were cancelled in view of December 2019 HC judgment that made National Eligibility and Entrance Test (NEET) mandatory for admission to bachelor’s degrees in Ayurvedic medicine, homeopathic medicine and Unani medicine in both Punjab and Haryana, the Supreme Court on Thursday allowed them to continue their course.

he Punjab and Haryana high court had refused to grant any relief to students who had approached it against cancellation of their admission due to December 18, 2019 judgment that upheld passing of the NEET as a necessary condition for grant of admissions to the BAMS/BHMS/BUMS courses.

The high court had declared invalid admissions of all candidates who did not qualify NEET to BAMS (Bachelor of Ayurvedic Medicine and Surgery), BHMS (Bachelor of Homeopathic Medicine and Surgery), and BUMS (Bachelor of Unani Medicine and Surgery) courses.

“We agree that doctors who are qualified in Ayurvedic, Unani and Homeopathy streams also treat patients and the lack of minimum standards of education would result in half-baked doctors being turned out of professional colleges. However, in view of admission of a large number of students to the AYUSH under-graduate courses for the year 2019-2020 on the strength of interim orders passed by the HC, we direct that the students may be permitted to continue provided that they were admitted prior to the last date of admission, October 15, 2019. The said direction is also applicable to students admitted to post-graduate courses before October 31, 2019,” the Supreme Court ordered.

The apex court, however, made it clear that this was only one-time exercise which has been permitted in view of the peculiar circumstances and the order shall not be treated as a precedent.
