There was an article few days back ie in April 2020 on this website mentioning that malaria caused by mosquito bite is to be treated as an accident for the purpose of claiming insurance. This was decided by the national consumer disputes redressal commission. I wish to point out that this decision was subsequently reversed by the h'ble Supreme court in 'The branch manager, National insurance company ltd v/s Mousumi Bhattacharjee' civil appeal no. 2614 of 2019 in SLP(C) 4297 of 2017 decided on 26/3/2019 by holding that malaria through mosquito bites is not unforeseen or unexpected, hence it is not an accident. In view of the Supreme court ruling, the reported decision of national commission ought to be treated as not enforceable. Please note that all the decisions of the National Consumer disputes redressal commission are not final; so restraint has to be exercised in reporting the decisions; they are reversed many times in the H'ble Supreme court.
